Terms & Conditions of Sale - Consumer (D2C)

Welcome to TrueStart Coffee Ltd. (“we”, “us”, “our”). These Terms & Conditions apply to all purchases made by individual consumers (“you”, “your”) on truestartcoffee.com, including one-time and subscription purchases. Please read them carefully before placing an order.

By placing an order, you agree to be bound by these Terms & Conditions.

1. Acceptance of Orders

  • When you place an order through our website, you will receive an email confirming receipt of your order. This acknowledgement does not mean your order has been accepted.
  • Your order is only accepted once we send you an email confirming that your order has been dispatched.
  • We reserve the right to refuse or cancel any order, for example if payment cannot be processed, the item is out of stock, or we reasonably suspect fraud or misuse.

2. Products and Availability

  • We take care to ensure that all product descriptions, images and prices on our website are accurate. However, errors may occur and we reserve the right to correct them.
  • All products are subject to availability. If an item is out of stock after you have ordered, we will contact you to offer an alternative, a refund, or an option to wait for restock.

3. Pricing and Payment

  • All prices shown on our website are in GBP (£) and include VAT at the current rate.
  • Delivery charges (if applicable) are displayed before checkout and confirmed in your order summary.
  • Payment must be made in full at the time of order. We accept major debit and credit cards and other payment methods listed at checkout.
  • We reserve the right to change prices at any time, but such changes will not affect orders already accepted.

4. Subscriptions

TrueStart Coffee subscriptions are designed to give you regular deliveries of your favourite coffee with full flexibility and transparency.

4.1 Starting a Subscription

  • By purchasing a subscription, you authorise us to charge your chosen payment method at the interval you selected (for example, every 2, 4 or 8 weeks).
  • You will receive an email confirmation when your first order is placed and before each renewal.

4.2 Managing Your Subscription

  • You can pause, change, or cancel your subscription at any time by logging into your account on truestartcoffee.com.
  • Any changes must be made at least 24 hours before your next order is due to be processed to take effect for that cycle.
  • If you cancel after your order has been processed, that delivery will still be fulfilled and charged as normal.

4.3 Price Changes

  • If we change the price of your subscribed product or delivery costs, we will notify you by email at least 14 days before your next renewal.
  • You will have the right to cancel your subscription before the new price takes effect.

4.4 Failed Payments

  • If your payment fails, we’ll notify you and attempt to process it again. If the issue continues, your subscription may be paused or cancelled until payment is successful.

5. Delivery

  • We deliver across the UK and other regions as specified on our website.
  • Delivery times and costs will be displayed at checkout. We aim to deliver within the indicated timeframes, but these are estimates only.
  • If we cannot deliver within 30 days of accepting your order, we will contact you to agree a new date or offer a full refund.
  • Risk passes to you once the goods are delivered to your specified address.

6. Returns, Refunds and Cancellations

6.1 Your Right to Cancel (One-Time Orders)

  • Under the Consumer Contracts Regulations 2013, you may cancel your order for any reason within 14 days of receiving your goods.
  • To cancel, please email diviein@truestartcoffee.com within 14 days of receipt, quoting your order number.
  • You must return the goods in their original, unopened condition within 14 days of notifying us. You are responsible for return shipping costs unless the goods are faulty or incorrect.

6.2 Subscription Cancellations

  • You can cancel your subscription at any time through your online account.
  • If you cancel before your next billing date, no further payments will be taken.
  • If your next order has already been processed, that shipment will still be sent and charged.

6.3 Faulty or Damaged Goods

  • If your order arrives damaged or faulty, please email divin@truestartcoffee.com within 7 working days of delivery, including your order number and photos if possible.
  • We will replace or refund the affected items in accordance with your statutory rights.

6.4 Refunds

  • Refunds will be made to the original payment method within 14 days of us receiving your returned goods or confirming a refund for damaged or missing items.

7. SMS

Mobile Terms of Service

The TrueStart Coffee mobile message service (the "Service") is operated by TrueStart Coffee (“TrueStart Coffee”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to TrueStart Coffee’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of TrueStart Coffee through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g. order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g. cart reminders).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with TrueStart Coffee. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt out of the Service at any time. Text the single keyword command STOP to TRUESTART or click the unsubscribe link (where available) in any text message to cancel. You’ll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other TrueStart Coffee mobile message programmes and wish to cancel, you will need to opt out separately by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honouring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the programme with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.

We respect your right to privacy. To see how we collect and use your personal information, please see our Privacy Notice.

8. Intellectual Property

All intellectual property rights in our products, packaging, website content, and branding remain the property of TrueStart Coffee Ltd. or its licensors. Nothing in these terms grants you any right to use or reproduce our intellectual property without our prior written consent.

9. Limitation of Liability

  • To the fullest extent permitted by law, our total liability to you for any loss, damage, or claim arising out of or in connection with your order, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall be strictly limited to the total amount you paid for that specific order.
  • We shall not be liable for any indirect, incidental, special, or consequential loss or damage, or for any loss of profit, revenue, goodwill, or data, whether foreseeable or not.
  • Nothing in these terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded or limited by law.

10. Force Majeure

We are not responsible for any failure or delay in performing our obligations caused by events outside our reasonable control, such as strikes, pandemics, transport disruption, or extreme weather.

11. Governing Law

These Terms & Conditions are governed by and construed in accordance with the laws of England & Wales, and any disputes shall be subject to the exclusive jurisdiction of the courts of England & Wales.

12. Updates to These Terms

We may update these Terms & Conditions from time to time. The version published on our website at the time of your order will apply to that order. Any significant changes to subscription terms will be communicated directly by email.
